Divorce in California

In California, the divorce proceeding begins with a court filing. If both parties are in agreement to the process, the process can be smoother but factors that complicate a divorce include time, money, and children that are involved. The divorce isn’t finalized until a judge issues a Judgment of Dissolution of Marriage.

Will I be paying my spouse spousal/child support?

If in the divorce process the other spouse is requesting child/spousal support, the request will still need to go in front of a judge. The judge is going to examine a variety of factors and untimely decide how much support is awarded to the other party.

My spouse is asking for a annulment/separation, how is this different from divorce?

An annulment means that due to certain circumstances (fraud, one party being under-age, bigamy, etc.) the marriage is deemed invalid since the inception. You still need to show to a judge and be granted an annulment.

Separation means that both parties are living apart but are still considered legally married to each other.
